The attorney’s for the LTISD have failed to follow the Texas Attorney General’s guidance regarding FERPA (remember, FERPA, The Family Educational Rights and Privacy Act, federal law concerning privacy and confidentiality). The AG’s office made this fact known to the lawyers who represent the LTISD as early as September 11, 2006 by means of an opinion letter. During a complaint hearing about this matter, the attorney for the LTISD stated that they were only made aware of this ruling in September 2006. Yet it was this same attorney who later failed to follow the ruling in which she had previously acknowledged.
